These Terms of Use govern the purchase, use, and access of the website templates sold by Marie Gems Digital. By purchasing, downloading, or using any of our templates, you agree to these terms. If you do not agree with any part of these terms, please refrain from purchasing or using our templates.
1. License and Usage
When you purchase a website template from Marie Gems Digital, you are granted a non-exclusive, non-transferable license to use the template for your personal or business use. This license allows you to:
Use the template for one (1) website only, unless otherwise specified or additional licenses are purchased.
Modify the template for your personal or commercial projects.
2. Restrictions
You may not:
Resell, redistribute, or share the template or any derivative works, whether modified or unmodified, to any third party.
Claim ownership of the template or the design elements within it, even after modification.
Use the template for illegal or unauthorized purposes.
If you wish to use a template for multiple websites, you must purchase additional licenses.
3. Ownership
All website templates, designs, and related assets remain the intellectual property of Marie Gems Digital. You are granted limited usage rights under these terms, but ownership of the template or design remains with us.
4. Refund Policy
Due to the nature of digital products, all sales of website templates are final. We do not offer refunds once the template has been purchased and downloaded. If you experience any issues with your purchase, please contact us, and we will assist with resolving the issue.
5. Template Modifications
You are free to modify the templates to fit your specific needs. However, all restrictions on reselling or redistribution of the modified template still apply. Marie Gems Digital is not responsible for any issues or errors that arise from modifications made to the template after purchase.
6. Support
Marie Gems Digital offers support for technical issues directly related to the functionality of the purchased template. Customization or third-party plugin support is not included, but we will guide you through any template-specific questions.
7. Updates
We may occasionally release updates to improve the template’s performance or address compatibility issues. You will be entitled to receive these updates for free for a period of 12 months from the date of purchase.
8. Limitation of Liability
Marie Gems Digital shall not be held liable for any damages, losses, or other issues arising from the use or inability to use the purchased templates, including but not limited to business interruptions, loss of profits, or data. The maximum liability to you shall not exceed the purchase price of the template.
9. Compliance with Laws
By using our templates, you agree to comply with all applicable local, national, and international laws and regulations. Any use of the templates for illegal activities or in violation of these Terms of Use will result in the immediate termination of your license.
10. Termination
Marie Gems Digital reserves the right to terminate your license and restrict your access to the purchased template if you violate these Terms of Use. Upon termination, you must cease all use of the template and destroy any copies you have.
11. Governing Law
These Terms of Use are governed by the laws of the State of Kansas. Any disputes related to these terms or the use of our templates shall be subject to the jurisdiction of the courts located in Wichita, Kansas.
